ORDINANCE #261

 

AN ORDINANCE OF THE BOROUGH OF SILVERDALE, BUCKS COUNTY, CONCERNING THE DECLARATION OF SNOW AND ICE EMERGENCY, PROHIBITION OF PARKING AND RESTRICTION OF DRIVING MOTOR VEHICLES ON SNOW EMERGENCY ROUTES DURING EMERGENCIES; AND PRESCRIBING PENALTIES FOR VIOLATION THEREOF

 

THE BOROUGH OF SILVERDALE HEREBY ENACTS AND ORDAINS AS FOLLOWS:

 

SECTION 1. DEFINITIONS.   As used in this Ordinance, the following terms shall have the meanings indicated, unless a different meaning clearly appears from the context:

           CARTWAY – Portion of a street or highway improved, designed, or ordinarily used for vehicular travel, exclusive of the berm or shoulder.

 

STREET or HIGHWAY – The entire width between the boundary lines of a way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.

 

SECTION 2. DECLARATION OF SNOW AND ICE EMERGENCY.  In order to facilitate the movement of traffic and to combat the hazards of snow and ice on the snow emergency routes named in Section 4 hereof, the Silverdale Borough Mayor, in his or her discretion, may declare a snow and ice emergency (designated in the Ordinance as a “Snow Emergency”).  Information of the existence of Snow Emergency may be provided by Silverdale Borough through radio, television, newspaper or other available media, and information on the termination of the Snow Emergency may be given by use of the same media.

 

SECTION 3.  PARKING PROHIBITED, DRIVING MOTOR VEHICLES RESTRICTED, ON SNOW EMERGENCY ROUTES DURING SNOW EMERGENCY.     After any Snow Emergency is declared, it shall be unlawful, at any time during the continuance of the Snow Emergency, for any person:

 

  1. To park a motor vehicle or to allow that vehicle to remain parked anywhere on any Snow Emergency route designated in Section 4 of this Ordinance; or

 

  1. To drive any motor vehicle on any such Snow Emergency route, unless that vehicle is equipped with all wheel drive, four wheel drive, front wheel drive, snow tires, chains or all-weather tires.

 

SECTION 4.  SNOW EMERGENCY ROUTES DESIGNATED.  The following Silverdale Borough roads and streets are designated as Snow Emergency routes:

 

 

Audrey Lane

Brighton Court

Burnish Court

Green Street

Lawndale Avenue

Noble Drive

Park Avenue

Parkway South

Silver Street

Sterling Drive

Wenger Avenue

 

Oak Drive

 

SECTION 5.  PENALTIES.

 

  1. If, at any time during a period of Snow Emergency declared under Section 2 of this Ordinance, a person shall park a motor vehicle or allow a motor vehicle to remain parked any where upon a Snow Emergency route, that person shall be guilty of a violation of this Ordinance, and upon conviction, shall be sentenced to pay a fine of not more than Six Hundred dollars ($600.00) and costs.

 

  1. If, at any time during a period of Snow Emergency declared under Section 2 of this Ordinance, a person shall drive a motor vehicle upon a Snow Emergency route, with out having that vehicle equipped with all wheel drive, four wheel drive, four wheel drive, front wheel drive, snow tires, chains or all-weather tires, that person shall be guilty of a violation of this Ordinance, and, upon conviction, shall be sentenced to pay a fine of Six Hundred Dollars ($600.00) and costs.
